Terms of Service

Effective Date: July 1, 2025

Article 1. Purpose

These Terms of Service ("Terms") define the conditions and procedures for using the MASCOZ service provided by Over the Hand Co., Ltd. ("Company"), as well as the rights, responsibilities, and obligations between users and the Company.

Article 2. Definitions

The main terms used in these Terms are defined as follows:
1.
โ€Serviceโ€: All services operated by the Company, including the MASCOZ platform, related websites, programs, software, and applications.
2.
โ€Userโ€: Any person who uses the Service in accordance with these Terms.
3.
โ€Contentโ€: All forms of materials posted on or used in connection with the Service, including but not limited to text, images, video, audio, links, items, slots, avatar elements, virtual assets (such as COZ), software, and code.
4.
โ€My Profileโ€: A feature where users can showcase their own content (such as images, videos, and avatar elements), and view or react to content shared by others. Content uploaded to My Profile is considered part of the Service, and its visibility or placement may be adjusted by the Company in accordance with applicable policies.
5.
โ€œCommunityโ€: A public area within the Service where users can share content and interact with others. The visibility and ranking of content in the Community are determined based on system algorithms and user engagement (e.g., Likes, views), and such criteria may change without prior notice.

Article 3. Notice, Effect, and Modification of the Terms

The Company may revise these Terms in accordance with changes in applicable laws or service policies. If the changes have a significant impact on users, notice will be provided at least 7 days prior to the effective date (30 days in advance for material changes).

Revised Terms take effect on the date specified in the notice.

Article 4. Account Management and Security

1.
Users are responsible for managing their account information securely and must not share it with others.
2.
If a user becomes aware of any unauthorized use or data breach, they must notify the Company immediately, and the Company will take appropriate action.
3.
The Company is not responsible for any issues arising from account theft or data leakage caused by the user's negligence.

Article 5. Use of the Service

1.
Sign-Up and Login

Users may sign up by registering an email and password. Domestic users must complete identity verification via phone.

Only those aged 14 or older may register. Guardian consent functionality may be added later, which could change the sign-up requirements.
2.
Avatar Creation and Features

Users can create their own avatars using provided items.
โ€ข
Avatars can be customized in terms of outfits, facial features, colors, etc. Items can be purchased with COZ.
โ€ข
Users can express themselves and interact with others through various features in the Service.
โ€ข
Some features require paid items or slots to unlock.
3.
Community and Profile

Users may create nicknames and profiles and interact with other users in the community.
โ€ข
Community activities must follow the Terms and community guidelines. Violations may lead to content removal or account restrictions, including:

Slander, harassment, discrimination, hate speech, or threats

Sexual or explicit content
โ—ฆ
Glorification or encouragement of suicide, self-harm, or illegal behavior

Politically or religiously provocative content

Scams, spam, or promotional content
โ—ฆ
Spreading false information or damaging the MASCOZ brand

The Company values freedom of expression but prioritizes safety and respect.

The Company may hide, remove, or restrict access to content without prior warning, especially in cases of repeated or serious violations.

Users must comply with separately posted guidelines and reporting policies. The Company is not responsible for any resulting disadvantages due to violations.

Article 6. Paid Services and Payment

The Company provides information about paid services (e.g., COZ charging, item and slot purchases) via the service UI or help center. This includes:

Names and descriptions of paid services
โ€ข
Fees and payment terms
โ€ข
Conditions and procedures for exchange, return, and refund
โ€ข
Supported devices and minimum technical requirements

Access to paid services may be restricted based on user age, identity verification, region, or platform policy.

Detailed rules for paid services, including payment, refund, and settlement, are defined in the Paid Services Terms and the Operations Policy.
4.
Due to the nature of digital content, once the content has been accessed (e.g., item granted, slot used), the right to cancel the purchase may be restricted under the E-Commerce Act. Specific standards are defined in the Operations Policy.
5.
The Company will handle submitted requests promptly and in good faith, and will make reasonable efforts to avoid unjustified delays.
6.
[Coming Soon] For any recurring paid services introduced in the future, terms such as auto-renewal, cancellation, payment method changes, and refund conditions will be clearly disclosed.

Article 7. User Obligations and Prohibited Conduct

Users must not engage in the following:
1.
Providing false information or using someone elseโ€™s personal data
2.
Infringing on othersโ€™ rights, reputation, or privacy
3.
Using the Service for commercial purposes as a corporation or organization without prior approval from the Company
4.
Engaging in reverse engineering, hacking, or automated data collection
5.
Any activity that disrupts or harms the operation of the Service

Article 8. Content and Intellectual Property

1.
Avatars and MASCOZ Content

All content, including avatars, is fully owned by the Company, and all related intellectual property rights belong to the Company.

The Company grants users a limited, non-exclusive, and non-transferable license to use such content for commercial purposes.
โ€ข
Individuals may produce and share goods (e.g., merchandise) using MASCOZ content for commercial purposes without prior approval from the Company, as long as such use does not harm the Company's reputation or infringe on the rights of third parties. However, certain types of commercial use, such as sales, may be subject to restrictions.

Corporations or organizations must obtain the Companyโ€™s prior written approval to use MASCOZ content for activities such as producing or selling merchandise, extracting 3D models, or developing systems.
โ€ข
Digital content (such as items, slots, avatar elements) and virtual assets (such as COZ) that users purchase or obtain through the Service are provided under a limited, non-exclusive, and non-transferable license granted by the Company. Ownership is not transferred to the user.
2.
User-Generated Content (UGC)

Copyright for user-created elements (excluding MASCOZ-provided assets) belongs to the user.
โ€ข
The Company may store, reproduce, display, distribute, broadcast, or create derivative works from such content for service operation, promotion, or improvement (worldwide, royalty-free, sub-licensable).

Content that violates these Terms, relevant laws, or community guidelines may be removed or restricted.

Article 9. Application, Termination, and Liability

1.
These Terms apply to all users of the MASCOZ Service. They take effect when posted within the Service or otherwise made available by the Company, and when agreed to by the user.

The Company may revise these Terms when deemed necessary. In such cases, the effective date, details of the revision, and reason for the change will be announced in advance.
3.
Users may delete their account through the Service settings or by contacting customer support. Upon account deletion, all user information will be deleted, except for data required to be retained under applicable laws.
4.
If a user violates these Terms, the Operations Policy, or any applicable laws, the Company may restrict the userโ€™s access to the Service or terminate the account without prior notice.
5.
The Company may suspend or terminate the Service for a user under any of the following circumstances and shall not be liable for any resulting damages:

Using false or stolen personal information

Distributing malware, launching system attacks, or other activities that compromise Service stability
โ€ข
Upon requests from regulatory authorities or public agencies
โ€ข
Any conduct that violates applicable laws or public order

Users are responsible for any damages caused to the Company or third parties due to violations of these Terms or relevant laws. If the Company receives a claim from a third party, the user shall indemnify the Company.
7.
The Company shall not be liable for any delay or interruption in Service caused by force majeure events, including but not limited to natural disasters, power outages, network failures, system errors, or external attacks.
8.
The Company is not responsible for any disputes, transactions, or defamation issues that may arise between users or between users and third parties, and bears no liability for damages caused by such issues.
9.
The Company does not guarantee any profits or outcomes expected by users through use of the Service. The Company shall not be liable for the loss, exposure, or alteration of general content unless caused by willful misconduct or gross negligence.
10.
The Company may change or discontinue the provision of digital content and virtual assets due to operational needs, policy changes, technical reasons, contract termination, or legal compliance.

Article 10. Interpretation and Other Provisions

1.
Any matters not defined in these Terms shall follow relevant laws and established practices.
2.
If any provision of these Terms is found to be invalid, the remaining provisions will remain in effect.
3.
Failure by the Company to enforce any part of these Terms shall not be considered a waiver of its rights.
This policy takes effect on July 1, 2025.
