Terms of Service

Effective Date: April 28, 2025

Article 1. Purpose

These Terms of Service ("Terms") define the conditions and procedures for using the MASCOZ service provided by Over the Hand Co., Ltd. ("Company"), as well as the rights, responsibilities, and obligations between users and the Company.

Article 2. Definitions

The main terms used in these Terms are defined as follows:
1.
Service: All services operated by the Company, including the MASCOZ platform, related websites, programs, software, and applications.
2.
User: Any person who uses the Service in accordance with these Terms.
3.
Content: All forms of materials related to or posted on the Service, including text, images, video, audio, links, software, and code.

Article 3. Notice, Effect, and Modification of the Terms

The Company may revise these Terms in accordance with changes in applicable laws or service policies. If the changes have a significant impact on users, notice will be provided at least 7 days prior to the effective date (30 days in advance for material changes).

Revised Terms take effect on the date specified in the notice.

Article 4. Account Management and Security

Users are responsible for managing their account information securely and must not share it with others.
2.
If a user becomes aware of any unauthorized use or data breach, they must notify the Company immediately, and the Company will take appropriate action.
3.
The Company is not responsible for any issues arising from account theft or data leakage caused by the user's negligence.

Article 5. Use of the Service

Sign-Up and Login

Users may sign up by registering an email and password. Domestic users must complete identity verification via phone.

Only those aged 14 or older may register. Guardian consent functionality may be added later, which could change the sign-up requirements.
2.
Avatar Creation and Features

Users can create their own avatars using provided items.
โ€ข
Avatars can be customized in terms of outfits, facial features, colors, etc. Items can be purchased with Coz.
โ€ข
Users can express themselves and interact with others through various features in the Service.
โ€ข
Some features require paid items or slots to unlock.
3.
Community and Profile

Users may create nicknames and profiles and interact with other users in the community.

Community activities must follow the Terms and community guidelines. Violations may lead to content removal or account restrictions, including:

Slander, harassment, discrimination, hate speech, or threats

Sexual or explicit content
โ—ฆ
Glorification or encouragement of suicide, self-harm, or illegal behavior

Politically or religiously provocative content

Scams, spam, or promotional content

Spreading false information or damaging the MASCOZ brand

The Company values freedom of expression but prioritizes safety and respect.

The Company may hide, remove, or restrict access to content without prior warning, especially in cases of repeated or serious violations.

Users must comply with separately posted guidelines and reporting policies. The Company is not responsible for any resulting disadvantages due to violations.

Article 6. Paid Services and Payment

The Company provides information about paid services (e.g., Coz charging, item and slot purchases) via the service UI or help center. This includes:

Names and descriptions of paid services
โ€ข
Fees and payment terms
โ€ข
Conditions and procedures for exchange, return, and refund
โ€ข
Supported devices and minimum technical requirements

Access to paid services may be restricted based on user age, identity verification, region, or platform policy.

Detailed rules for paid services, including payment, refund, and settlement, are defined in the Paid Services Terms and the Operations Policy.
4.
Due to the nature of digital content, once the content has been accessed (e.g., item granted, slot used), the right to cancel the purchase may be restricted under the E-Commerce Act. Specific standards are defined in the Operations Policy.
5.
The Company will handle submitted requests promptly and in good faith, and will make reasonable efforts to avoid unjustified delays.
6.
[Coming Soon] For any recurring paid services introduced in the future, terms such as auto-renewal, cancellation, payment method changes, and refund conditions will be clearly disclosed.

Article 7. User Obligations and Prohibited Conduct

Users must not engage in the following:

Providing false information or using someone elseโ€™s personal data

Infringing on othersโ€™ rights, reputation, or privacy
3.
Using the Service for commercial purposes as a corporation or organization without prior approval from the Company
4.
Engaging in reverse engineering, hacking, or automated data collection
5.
Any activity that disrupts or harms the operation of the Service

Article 8. Content and Intellectual Property

Avatars and MASCOZ Content

All content, including avatars, is owned by the Company, and related intellectual property belongs to the Company.

The Company grants users a limited, non-exclusive, non-transferable license to use such content for non-commercial purposes.
โ€ข
Individuals may produce and share goods (e.g., merchandise) using MASCOZ content for non-commercial purposes without prior approval from the Company, provided that such use does not damage the Companyโ€™s reputation or infringe on the rights of third parties. Commercial activities such as selling merchandise may be restricted.

Corporations or organizations must obtain prior written approval from the Company to use MASCOZ content for activities such as merchandise production, sales, 3D model extraction, or system development.

Use of MASCOZ content on platforms like YouTube or Twitch is allowed for non-commercial or monetized purposes (e.g., ad revenue, Super Chat), subject to platform policies. The Company is not liable for third-party platform activities.
2.
User-Generated Content (UGC)

Copyright for user-created elements (excluding MASCOZ-provided assets) belongs to the user.
โ€ข
The Company may store, reproduce, display, distribute, broadcast, or create derivative works from such content for service operation, promotion, or improvement (worldwide, royalty-free, sub-licensable).

Content that violates these Terms, relevant laws, or community guidelines may be removed or restricted.

Article 9. Application, Termination, and Liability

These Terms apply to all users of the MASCOZ service. They take effect when posted and agreed upon by the user.
2.
The Company may revise these Terms and will provide notice of the effective date, changes, and reasons.
3.
Users may delete their account via settings or customer support. Upon account deletion, all user data will be removed except where retention is required by law.
4.
If a user violates these Terms, the Operations Policy, or relevant laws, the Company may suspend service or terminate the account without notice.
5.
The Company may restrict or terminate service and is not liable for damages in the following cases:

Use of false or stolen information
โ€ข
Distribution of malware, system attacks, or other harmful acts
โ€ข
Requests from regulatory authorities or public institutions
โ€ข
Other acts that violate laws or public order

Users are responsible for compensating any damages caused to the Company or third parties due to violations. If the Company receives claims from third parties, the user must indemnify the Company.
7.
The Company is not liable for service delays or interruptions due to force majeure events such as natural disasters, blackouts, network failures, system errors, or external attacks.
8.
The Company is not involved in disputes or issues between users or between users and third parties and is not liable for any resulting damages.
9.
The Company does not guarantee any profits or outcomes expected by users and is not responsible for any content loss, exposure, or alteration unless caused by intentional or gross negligence.

Article 10. Interpretation and Other Provisions

1.
Any matters not defined in these Terms shall follow relevant laws and established practices.
2.
If any provision of these Terms is found to be invalid, the remaining provisions will remain in effect.
3.
Failure by the Company to enforce any part of these Terms shall not be considered a waiver of its rights.
This policy takes effect on April 28, 2025.
